Terms of use

These are our current, plain-language terms for using KindyWords. We’re finalising the formal legal terms with our lawyer and will update this page — but everything here is true today.

Who KindyWords is for

KindyWords is an AI writing mentor for children aged 4–9, operated by XCELERENT (ABN 65 397 914 685), based in Australia. It’s for parents and guardians: you must be 18 or over and the parent or legal guardian of any child you register. The account holder is always the adult — a child never has their own account, never logs in, and only uses the mentor through your device and account. You’re responsible for keeping your login secure.

What KindyWords does — and doesn’t

Your child’s writing is yours

Your child’s writing belongs to you. You give KindyWords permission to use it only to provide the service — to read it and reply, and to keep the practice history described in our privacy notes. We never sell it, publish it, share it, or use it to train third-party AI. Photos are read and then not stored; only the text is kept, and it’s deleted on the 12-month retention schedule or whenever you delete it.

Fair use

Please only send your own child’s writing, don’t try to reach other families’ data, and don’t attack or misuse the service. We may suspend accounts that break these terms.

Plans and payment

The full child experience is free, forever. Optional paid plans (Basic, Premium) add parent-side features and are billed through Stripe at the amount and currency shown at checkout, for the interval you choose. You can cancel any time from the parent portal — you keep your paid features until the end of the period you’ve paid for, then the account simply reverts to free. Nothing about your child’s data is lost. See our refund notes.

Changes and closing your account

We may add, change, or retire features, and we’ll give reasonable notice of anything material. You can stop using KindyWords and delete your account at any time from the parent portal, which removes your family’s data.

Your consumer rights

Your rights under the Australian Consumer Law always apply and cannot be excluded by anything on this page. If the service has a major problem, you may be entitled to a repair, replacement, or refund.

Privacy

How we handle your family’s information is set out in our privacy notes — Australian data residency, photos not stored, your access and deletion rights, and the independent child-privacy review our conditions come from.

Governing law

These terms are governed by the laws of Australia. Your non-excludable rights under the Australian Consumer Law apply wherever you live.
